1. Scope

These General Terms and Conditions (GTC) apply to all orders and transactions made through the Travelaround Galerie online shop.

2. Contracting party

The purchase contract is concluded with:

3. Offers and conclusion of contract

(1) The products presented in the shop do not constitute a legally binding offer, but a non-binding invitation to submit an offer by the customer.

(2) By submitting an order, the customer submits a binding offer to purchase. The contract is concluded as soon as the seller confirms the order by email.

4. Description of services

We sell digital photographs and canvas prints, which are made available digitally after purchase or shipped to the address provided. Use of the files is determined by the license type purchased.

The following license types are offered:

a) Private License

• For private use on screens, smartphones, smart TVs & private social media channels.
• No printing rights, no commercial use, no distribution or resale permitted!
• Attribution is not required.

b) Business license with mention

• For digital commercial use on websites, presentations and social media
  
• The author's name must be mentioned in the following form: Roland / Travelaround Galerie
• No printing rights! Distribution or resale of the file is prohibited.

c) Business license without mention

• Use for commercial purposes without obligation to attest to copyright.
• Printing for flyers, magazines or similar is easily possible.
• No distribution or resale of the file permitted.

The respective license is selected by the customer upon purchase and applies exclusively to the respective image.

A transfer of the license to other works or buyers is excluded.

The canvas prints offered are high-quality fine art prints, produced individually upon request. The motifs are exclusively my own, Roland Zimmermann, and are protected by copyright. The customer selects from the motifs, sizes, and designs presented in the online shop.

5. Prices and payment

(1) All prices are stated in euros or the respective national currency.

Since Travelaround Media eU is registered as a small business in Austria, the prices do not include VAT in accordance with the small business regulation (Section 6 (1) (27) UStG).

(2) Payment can be made by credit card, PayPal, Apple/Google Pay, EPS transfer and Klarna.

(3) In case of late payment, we reserve the right to charge interest on arrears.

6. Delivery and shipping

(1) The digital images will be made available immediately after receipt of payment via a download link or by email to the specified address.

(2) The customer is responsible for storing and securing the digital files.

Canvas prints are produced individually upon receipt of the order. The order is manually forwarded to our production partner Saal Digital as soon as payment is received. Production then typically begins the next business day at the latest. There is no automatic interface.

Shipping will be carried out via a service provider selected by Saal Digital (Austrian Post, DHL, UPS or others).

We assume no liability for delivery delays that are beyond our control (e.g. caused by logistics service providers).

7. Right of withdrawal

(1) According to Section 18 (1) (11) FAGG, there is no right of withdrawal for digital content if the customer expressly agrees before ordering that the execution of the contract will begin before the expiry of the withdrawal period and he thereby loses his right of withdrawal.

(2) By purchasing a digital image, the customer expressly agrees to waive his right of withdrawal.

According to Section 312g Paragraph 2 No. 1 of the German Civil Code (BGB), there is no right of withdrawal for contracts for goods that were manufactured according to customer specifications or are clearly tailored to your personal needs.

8. Warranty and Liability

(1) The statutory warranty rights apply.

(2) The seller is not liable for damages resulting from improper use of the digital images.

11. Final provisions

The law of the Republic of Austria applies.
For entrepreneurs, the place of jurisdiction is the registered office of my company.
Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
